1. Scope and Applicability

Caliplaces s.r.o. ("we," "us," "our," "Caliplaces") is a hosting and intermediary service provider as defined by Regulation (EU) 2022/2065 (Digital Services Act, "DSA"). This policy explains how we comply with the DSA and how users can report illegal content hosted on our platform.

This policy applies to all content uploaded, published, or shared through the Caliplaces platform, including but not limited to user profiles, service listings, reviews, ratings, messages, and any other user-generated content.

2. What Constitutes Illegal Content

Under the DSA, "illegal content" refers to information that is not permitted by the laws of the European Union or the laws applicable in the Member State where the service is offered. Examples of illegal content include:

  • Content that violates criminal law (e.g., incitement to violence, terrorism, child exploitation material)
  • Hate speech or discrimination based on protected characteristics
  • Defamation, libel, or false accusations
  • Intellectual property infringement (copyright, trademarks, patents)
  • Fraud, scams, or deceptive commercial practices
  • Consumer protection violations
  • Data protection violations (GDPR)
  • Counterfeit goods or services
  • Content facilitating illegal transactions or services

3. How to Submit a Notice (Article 16 DSA)

Any person or entity that becomes aware of illegal content on the Caliplaces platform may submit a notice. To be processed, notices must include:

Required Information (Article 16(1)):

  • Sufficient information to identify the illegal content (URL, user ID, timestamp, or specific location within the platform)
  • Explanation of why the content is believed to be illegal, including reference to specific laws violated
  • Notifier information:
    • Contact details (name, email, phone number)
    • Whether you are reporting on your own behalf or on behalf of a third party
    • Affirmation that the information provided is accurate to the best of your knowledge
  • Evidence supporting your claim (documents, screenshots, links to applicable law)

4. Notice Processing Procedure

Upon receipt of a notice, Caliplaces will follow this procedure:

Step 1: Acknowledgment

We will acknowledge receipt of your notice within 24 hours, confirming the notice number and expected processing timeline.

Step 2: Assessment

Our review team will assess whether the reported content is illegal under applicable law. This may include:

  • Examining the reported content
  • Consulting applicable laws and regulations
  • Gathering additional information if necessary
  • Consulting with legal counsel if needed

Step 3: Decision

We will determine whether to remove, restrict, or retain the content and notify you of our decision.

Step 4: Implementation

If we determine the content is illegal, we will take action as described in Section 7 below.

5. Processing Timelines

Caliplaces will process notices in compliance with Article 17 DSA:

In urgent cases where content poses an imminent risk of serious harm, we may take action faster than the standard timeline.

6. Counter-Notice Procedure

If your content was removed or restricted based on a notice, you may submit a counter-notice if you believe the content is not illegal.

Counter-Notice Requirements:

  • Specific identification of the removed/restricted content
  • Clear explanation of why you believe the content is not illegal (reference to applicable law)
  • Your contact details and affirmation of truthfulness
  • Submission to legal@caliplaces.com

Upon receipt of a valid counter-notice, we will:

  1. Acknowledge receipt within 24 hours
  2. Re-assess the content based on the counter-notice
  3. Decide whether to restore the content within 45 days
  4. Notify both parties of our decision

7. Consequences of Illegal Content

When Caliplaces determines that content is illegal, we will take appropriate action:

Removal

The illegal content will be removed from the platform entirely and will no longer be accessible to any user.

Restriction

The content may be restricted (e.g., hidden from search results, de-ranked, or marked with a warning) rather than fully removed in some cases.

Account Action

If a user repeatedly uploads illegal content, their account may be suspended or terminated.

Users will be notified when their content is removed or restricted, including the reason and their right to submit a counter-notice.

8. Transparency Reporting

In compliance with Article 24 DSA, Caliplaces publishes an annual transparency report that includes:

  • Number of notices received
  • Number of notices acted upon (content removed/restricted)
  • Number of counter-notices received
  • Categories of illegal content most frequently reported
  • Average processing times
  • Actions taken against users for repeated violations

Our transparency reports are published on our website and are available to regulatory authorities and the public.

9. Trader Information Requirements (Article 30)

Caliplaces acts as a marketplace where trainers, coaches, and other service providers ("traders") offer services. Under Article 30 DSA, we require all traders to maintain and provide:

Required Trader Information:

  • Full name
  • Geographic address where the trader is established
  • Contact email address
  • Phone number
  • Company registration number (if applicable, such as business ID or VAT number)
  • Professional qualifications and certifications
  • Bank account or payment method details

This information is verified during onboarding and must be kept current. Traders are responsible for updating their information if it changes. Providing false information may result in account suspension or termination.

10. Internal Complaint Handling (Article 20)

Users may lodge complaints with Caliplaces about our moderation decisions, including content removal or account restrictions. Our complaint-handling procedure:

Submission

Submit complaints to legal@caliplaces.com with "Complaint" in the subject line, including specific details of the decision you are disputing.

Acknowledgment

We will acknowledge receipt of your complaint within 24 hours and assign it a reference number.

Review

Our complaints team will review your complaint and contact you if we need additional information.

Decision

We will issue a decision within 45 days of receipt, including our reasoning and your right to seek out-of-court dispute settlement.

11. Out-of-Court Dispute Settlement (Article 21)

If you are not satisfied with Caliplaces' internal decision on a complaint, you may pursue out-of-court dispute resolution:

Independent Mediator:

Caliplaces may also refer disputes to an independent mediator. Costs of mediation will be borne equally by both parties unless otherwise agreed.

12. Reporting to Authorities

Caliplaces may report illegal content to law enforcement and regulatory authorities when:

  • Content involves imminent risk of serious harm
  • Content involves child exploitation or abuse
  • Content involves terrorism or national security threats
  • Required by applicable law or legal order
  • Required to protect our users, platform, or business

Where legally permitted, we will notify the affected user that we have reported content to authorities.
