Caliplaces Marketplace Terms

1. Marketplace Overview

Caliplaces ("we," "us," "our," or "the Platform") operates an online marketplace that connects users and consumers ("Users") with independent trainers and fitness coaches ("Trainers") offering calisthenics training services. These Marketplace Terms govern the use of our marketplace, including the booking, payment, and dispute resolution processes between users and trainers.

The Caliplaces marketplace is a digital platform that facilitates the connection between service providers (Trainers) and service recipients (Users). Caliplaces is incorporated as Caliplaces s.r.o., a Czech limited liability company registered with the Commercial Register under IČO 23311207, with its registered office at Uralská 689/7, Bubeneč (Praha 6), 160 00 Praha.

2. Role of Caliplaces

Caliplaces operates exclusively as an intermediary platform and does not directly provide training services. Our role is limited to:

  • Facilitating the connection between Users and Trainers
  • Providing the technical infrastructure (website, mobile applications, booking system)
  • Handling payment processing through third-party payment providers
  • Providing dispute resolution services between Users and Trainers
  • Moderating content and enforcing community standards

Not a Party to Service Contracts

Caliplaces is not a party to the service contract between Users and Trainers. Each booking creates a direct contractual relationship between the User and the Trainer for the provision of training services. Caliplaces acts solely as a neutral intermediary facilitating this transaction.

The Trainer is responsible for:

  • Providing the training services as described in their profile and booking details
  • Ensuring service quality, availability, and responsiveness to Users
  • Compliance with applicable laws and regulations in the jurisdiction where services are provided
  • Maintaining professional liability insurance (if required)
  • Proper conduct and adherence to our Acceptable Use Policy

Caliplaces does not guarantee or warrant the quality, safety, legality, or fitness of any training services provided. For detailed trainer obligations, see the Trainer & Coach Terms.

3. Booking Process

How Bookings Work

Users may book training sessions with Trainers through the Caliplaces platform. The booking process involves:

  1. User Selection: The User browses trainer profiles and selects a service offering.
  2. Booking Request: The User submits a booking request with preferred date(s), time(s), and any special requests.
  3. Trainer Confirmation: The Trainer reviews the booking request and accepts or declines within the timeframe specified in their profile (typically within 24–48 hours).
  4. Payment Authorization: Upon Trainer acceptance, payment is authorized. The amount is held temporarily (see Payment Processing section).
  5. Booking Confirmation: Once payment is authorized, the booking is confirmed, and both parties receive notification with session details.

Booking Confirmation

A booking is confirmed once:

  • The Trainer has accepted the booking request
  • Payment has been successfully authorized
  • Both User and Trainer have received confirmation via email or in-app notification

Confirmed bookings are binding on both the User and the Trainer, subject to the cancellation rights described below.

Cancellation by User

Users may cancel confirmed bookings according to the following cancellation policy:

  • More than 48 hours before session: Full refund (100%) minus any applicable transaction fees, unless the Trainer's cancellation policy is more restrictive.
  • 24–48 hours before session: Partial refund (50%) as per trainer's policy or platform default.
  • Less than 24 hours before session: No refund (0%), payment forfeited to Trainer.
  • No-show (User does not attend): No refund; Trainer retains full payment.

EU consumers may have additional cancellation and withdrawal rights under the Consumer Rights Directive (14-day withdrawal period, see Refund Policy for details).

Cancellation by Trainer

Trainers may cancel confirmed bookings only in exceptional circumstances (illness, emergency, unavoidable absence). When a Trainer cancels:

  • The User receives a full refund immediately
  • The User is offered rebooking with the Trainer at no penalty or with an alternative trainer
  • Repeated unjustified cancellations by a Trainer may result in account suspension or termination

4. Fees and Commissions

Platform Fee

Caliplaces charges a platform commission fee on each completed training session booking. The fee structure is:

  • Platform Commission Rate: 15% of the session price (excluding VAT and taxes)
  • Payment Processing Fee: Stripe and other payment processor fees (passed through at cost)
  • Subscription Revenue (RevenueCat): Caliplaces retains subscription fees for premium features or membership tiers (if applicable)

Trainer Payout

The amount paid to the Trainer is calculated as follows:

Trainer Payout = (Booking Price) − (Platform Commission) − (Payment Processing Fees) − (Applicable Taxes/VAT)

Example: If a User books a €100 session and the platform commission is 15%, the Trainer receives approximately €85 after deduction of fees and applicable taxes.

Transparent Fee Disclosure

All fees are clearly displayed to Users before they confirm a booking. Trainers can view their expected payout for each session in their dashboard. No hidden or surprise fees are charged.

5. Payment Processing

Payment Methods

Caliplaces uses Stripe as its primary payment processor for user-to-trainer transactions and payout management. Payment methods accepted include:

  • Credit and debit cards (Visa, Mastercard, American Express)
  • Bank transfers and local payment methods (as supported by Stripe in your region)
  • Other payment methods as made available through Stripe

Subscription Payments

Subscription payments (if applicable) are processed through RevenueCat, which securely handles recurring billing and platform subscriptions.

Escrow-like Payment Flow

Caliplaces implements a secure payment flow that protects both Users and Trainers:

  1. Authorization: When a User confirms a booking, their payment is authorized (but not immediately charged if using a card).
  2. Hold: Payment is temporarily held pending the completion of the training session or expiry of the cancellation window.
  3. Release/Settlement: After the session date passes and the cancellation period expires, payment is settled to the Trainer's connected Stripe account.
  4. Refund: If the User cancels within the allowed period, payment is refunded to their original payment method.
  5. Dispute Resolution: If a dispute is raised, payment may be held pending investigation and resolution.

Payout Schedule

Trainers connected via Stripe Connect receive payouts according to the following schedule:

  • Settlement Timing: Payouts are processed to trainer bank accounts within 2–5 business days after a session is completed and the cancellation period expires (typically 3–4 days after the session date).
  • Payout Frequency: Payouts are processed in batches, typically daily or according to Stripe's payout schedule.
  • Minimum Payout Threshold: Trainers must maintain a minimum balance before payouts are triggered (minimum payout amount determined by Stripe and local regulations, typically €10–25).
  • Payout Currency: Payouts are processed in EUR or the trainer's local currency (depending on their Stripe account currency setting).

Failed Payments and Chargebacks

If a payment is declined or disputed:

  • The User is notified and provided an opportunity to provide alternative payment details
  • If payment fails, the booking is cancelled automatically, and no session occurs
  • Chargeback disputes are handled according to Stripe's dispute resolution process; Caliplaces may charge a chargeback fee to the User if deemed fraudulent

6. Reviews and Ratings

Review Policy

After a completed training session, Users may leave ratings and written reviews of the Trainer and the service received. These reviews are visible to other potential Users and help maintain platform quality and trust.

Review Moderation Rules

All reviews must comply with the following guidelines:

  • Reviews must be based on genuine, completed training sessions
  • Reviews must be truthful and factually accurate
  • Reviews must not contain abusive, defamatory, or harassing language
  • Reviews must not reveal personal information (phone numbers, addresses, etc.)
  • Reviews must not include irrelevant commercial or promotional content
  • Reviews must not discriminate based on protected characteristics (race, gender, religion, disability, etc.)

Review Removal Criteria

Caliplaces may remove or hide reviews that:

  • Violate the guidelines listed above
  • Are posted by users who did not complete the session
  • Contain false or misleading claims that have been verified as inaccurate
  • Are suspected to be fake, incentivized, or manipulated reviews
  • Violate intellectual property rights or contain copyrighted material
  • Contain illegal content or incitement to illegal activity

Trainers may request removal of reviews they believe violate these guidelines. Caliplaces will investigate and take appropriate action within 5–7 business days.

Ratings Algorithm

Trainer ratings are calculated as an average of all verified reviews. Caliplaces uses a transparent algorithm that:

  • Weights recent reviews more heavily than older reviews
  • Filters out suspected fake or manipulated reviews
  • Excludes reviews from unverified bookings
  • Displays the total number of reviews and rating distribution

7. Dispute Resolution

Dispute Categories

Disputes may arise between Users and Trainers regarding:

  • Non-delivery or poor quality of training services
  • Unauthorized cancellations or no-shows
  • Inappropriate conduct by the Trainer
  • Failure to refund as per policy
  • Disagreement about session completion or payment

Dispute Resolution Process

The following process applies when a dispute is raised:

  1. Reporting: The party initiating the dispute submits a detailed report within 30 days of the disputed session through the Caliplaces platform or by contacting support@caliplaces.com.
  2. Initial Assessment: Caliplaces reviews the dispute and may request additional information from both parties (typically within 2–3 business days).
  3. Investigation: Caliplaces investigates the dispute, including review of session details, messaging history, and any evidence provided. Investigation typically takes 5–7 business days.
  4. Resolution Decision: Caliplaces issues a decision, which may include:
    • Ordering a refund to the User
    • Ordering payment to the Trainer if payment was improperly withheld
    • Splitting the disputed amount between parties
    • Dismissing the dispute if insufficient evidence supports the claim
  5. Appeal: Either party may appeal the decision within 7 days. A senior Caliplaces representative will review the appeal (final decision).
  6. Execution: Once a decision is final, Caliplaces executes the resolution by processing refunds or payments via Stripe.

Dispute Timeframes

Disputes must be reported within 30 days of the disputed session. Disputes reported after this period will not be accepted unless there are exceptional circumstances (fraud, system error, etc.).

8. Refund Rules

Refund eligibility is determined by the timing of cancellation and the circumstances of the dispute. For a detailed refund policy including EU consumer withdrawal rights, see the separate Refund & Cancellation Policy document.

In summary:

  • User Cancellation (48+ hours before): Full refund to original payment method within 3–5 business days
  • User Cancellation (24–48 hours): Partial refund (50%) as per trainer's policy
  • User Cancellation (<24 hours or no-show): No refund; Trainer retains payment
  • Trainer Cancellation (any time): Full refund to User immediately
  • Service Not Provided (Trainer no-show or failure): Full refund to User following dispute resolution
  • EU Consumer Withdrawal Right (14 days): EU consumers may withdraw from service contracts within 14 days of booking, subject to service completion clauses

9. Content Moderation and Reporting

Moderation Standards

All content on the Caliplaces platform—including trainer profiles, session descriptions, reviews, messages, and user-generated content—must comply with our Acceptable Use Policy and applicable laws.

Content that violates these standards includes:

  • Illegal content (child exploitation, trafficking, extreme violence, etc.)
  • Hateful content targeting protected characteristics (race, religion, gender, disability, sexual orientation)
  • Misinformation or harmful health claims
  • Spam, scams, or phishing attempts
  • Copyright or trademark infringement
  • Sexually explicit content (unless in appropriate fitness contexts)
  • Personal harassment, threats, or abuse
  • Fraud or deceptive practices

Reporting Mechanism

Users and Trainers may report violating content through:

  • The "Report" button available on profiles, reviews, and messages
  • Direct contact to abuse@caliplaces.com or support@caliplaces.com
  • The DSA Notice & Action Policy reporting form (for illegal content)

Moderation Timeline

Caliplaces commits to the following moderation response times:

  • Illegal content (CSAM, trafficking, violence): Removal within 24 hours; report to authorities within 48 hours
  • Hate speech or harassment: Review within 48 hours; removal if violations confirmed
  • Other violations: Review within 5–7 business days; action taken as appropriate

Content Removal and Account Actions

If content is removed or an account is suspended, the affected user receives:

  • Clear notification of what content/action triggered the removal
  • Explanation of which policy was violated
  • Opportunity to appeal the decision within 7 days
  • Restoration of content if the appeal is upheld

10. DSA Compliance

Digital Services Act Obligations

Caliplaces is an intermediary platform subject to the Digital Services Act (Regulation (EU) 2022/2065). In compliance with DSA requirements, Caliplaces:

  • Maintains transparent terms of service and content moderation policies
  • Provides accessible reporting mechanisms for illegal content
  • Takes prompt action on reported illegal content (within legal compliance timeframes)
  • Maintains internal due diligence systems to detect and mitigate systemic illegal content risks
  • Provides transparency reports on content moderation actions (published annually)
  • Implements risk assessment and mitigation measures for freedom of expression and fundamental rights
  • Allows researchers and public authorities to conduct audits and investigations

Illegal Content Reporting

Users and third parties may report illegal content through our dedicated DSA reporting form. See the DSA Notice & Action Policy for detailed reporting procedures and timelines.

Transparency and Accountability

Caliplaces publishes annual transparency reports detailing:

  • Number of content removal notices received and actioned
  • Categories of illegal content reported and removed
  • Average response times for different content types
  • Data on coordinated inauthentic behavior and bot detection
  • Details on any systemic risks identified and mitigation measures taken

11. Ranking and Display Order Transparency (P2B Regulation)

Ranking Parameters

Trainer profiles and services are displayed to Users through various ranking mechanisms, including search results, category listings, and recommended trainers. The ranking of Trainers is determined by the following parameters (in order of weight):

  • User Rating & Reviews (40%): Average rating and volume of verified reviews from completed sessions
  • Completion Rate (25%): Percentage of bookings completed (not cancelled) by the Trainer
  • Response Time (15%): Average time to accept or respond to booking requests
  • Recency (10%): Freshness of content and recent activity
  • Profile Completeness (10%): Completeness and quality of profile information and description

Ranking Factors Not Used

Caliplaces does not employ paid ranking boosts or advertisements that alter organic search results based on payment or commission arrangements. All trainers are ranked fairly according to the parameters above, regardless of commission or fee structure.

Transparency of Changes

When Caliplaces modifies ranking algorithms or search results:

  • Detailed notification is provided to all affected Trainers
  • Changes are documented and explained on a dedicated transparency page
  • Trainers are given reasonable advance notice (at least 30 days) before material changes take effect
  • A complaints procedure is available for Trainers who believe ranking changes are unfair (see P2B Regulation Art. 11)

Search and Discovery

Users can filter and sort trainers by various criteria (location, price, rating, availability) to find services matching their preferences. All sorting and filtering mechanisms are transparent and clearly labeled.

12. Platform Liability Limitations

Limited Liability

To the extent permitted by law, Caliplaces's liability for damages arising from use of the marketplace is limited to:

  • Direct damages directly caused by Caliplaces's gross negligence or willful misconduct
  • The total amount paid by the User through the platform in the 12 months preceding the claim
  • Refunds or payouts processed through dispute resolution (as described in section 7)

Exclusion of Certain Damages

Caliplaces is not liable for:

  • Indirect, incidental, special, or consequential damages (lost profits, lost data, business interruption)
  • Quality, safety, or effectiveness of training services provided by Trainers
  • Physical injury or harm resulting from training sessions
  • Loss of data due to User error, device malfunction, or internet connectivity issues
  • Unauthorized access to accounts due to weak passwords or compromised credentials
  • Third-party content, links, or external websites

Trainer Responsibility

Trainers are independent service providers and are solely responsible for:

  • The quality and safety of training services
  • Compliance with applicable laws and regulations
  • Obtaining necessary licenses, certifications, and insurance
  • Proper conduct and adherence to platform policies
  • Indemnifying Caliplaces against claims arising from their services or misconduct

13. Changes to Marketplace Terms

Right to Modify

Caliplaces reserves the right to modify these Marketplace Terms at any time. Material changes will be communicated with appropriate advance notice:

  • Minor updates: Effective immediately (clarifications, formatting)
  • Moderate changes: 30 days advance notice (fee adjustments, new features)
  • Material changes: 90 days advance notice (fundamental policy changes, business model shifts)

Continued Use

Continued use of the Caliplaces platform after changes become effective constitutes acceptance of the updated terms. If you do not accept changes, you may terminate your account and request a refund of any pending balance.

Notification Method

Changes are communicated through:

  • Email notification to your registered account email
  • In-app notification banner
  • Publication on the Caliplaces legal website
  • Announcement in the platform dashboard

Applicable Law and Jurisdiction

These Marketplace Terms are governed by the laws of the Czech Republic and the European Union. Disputes are resolved according to the dispute resolution process outlined in Section 7, with European mediation and arbitration provisions available as required by the P2B Regulation and EU law.
