1. Scope and Acceptance

These Open API Terms of Use (the "API Terms") govern your access to and use of the Caliplaces Open API at https://api.caliplaces.com/open/v1, the developer portal at developer.caliplaces.com, API projects and keys, and prepaid credits. They are an agreement between you and Caliplaces s.r.o., IČO 23311207, with its registered office at Uralská 689/7, Bubeneč (Praha 6), 160 00 Praha ("Caliplaces", "we", "us").

You accept the API Terms when you create an API project, create an API key, buy credits or call the API. If you act on behalf of a company or other organisation, you confirm that you may bind it, and "you" means that organisation.

The Caliplaces Terms of Service and Acceptable Use Policy also apply to your Caliplaces account. Where they conflict with the API Terms on the use of the API, the API Terms prevail. Use of the API in line with the API Terms is an authorised exception to the restrictions on copying, systematic access and commercial use in Sections 10 and 11 of the Terms of Service.

2. Definitions

  • API: the Caliplaces Open API and its documentation.
  • Application: the website, app, service or software in which you use the API.
  • Caliplaces Data: any data returned by the API, including place, city, event and coach information, ratings and photos.
  • API Key: a secret key issued to one of your projects in the developer portal.
  • Credits: prepaid units used to pay for calls on the pay as you go plan, where 1 credit has a value of €1 excluding VAT.
  • Consumer: an individual acting for purposes outside their trade, business, craft or profession.

3. Licence to Use the API

Subject to the API Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to call the API with your API Keys and to display Caliplaces Data to the users of your Application, including in commercial Applications, within the limits of your plan.

The licence covers displaying Caliplaces Data in your Application. It does not let you redistribute Caliplaces Data as data (see Section 10). All rights not expressly granted are reserved.

4. API Keys and Security

  • Keep API Keys secret. Call the API from your server and never place a key in a website, mobile app or public repository.
  • You are responsible for all calls made with your API Keys, including calls charged to your credits.
  • If a key may have leaked, revoke it in the developer portal straight away and create a new one.
  • Do not share keys with third parties or use one project's keys for another, unrelated Application.
  • We may revoke a key that we believe has been exposed or misused, and will tell you when we do.

5. Plans and Limits

The free plan is for building and testing. Its limits (currently 5 requests a minute and 1,000 requests a month per account, shared by all of the account's free projects) are published in the developer portal and may change. The pay as you go plan has its own rate limit per project and no monthly request cap, and every successful call is paid for with Credits.

You may not get around the limits, for example by creating several accounts or projects for one Application, rotating keys or sharing keys with others. Requests over a limit are refused with an error and are not charged.

6. Prepaid Credits and Payment

  • Buying credits. Credits are bought in advance through Stripe in the developer portal. Prices are shown excluding VAT; VAT is added where it applies. You receive an invoice for every purchase. Promotional bonus credits may be offered for larger purchases.
  • Prices. The price of a call is published in the developer portal and on the pricing page. Only successful calls are charged. Calls that end in an error, including errors on our side, cost nothing. We may change prices with at least 30 days' notice by email. A change applies to calls made after it takes effect; the credits you hold keep their value of €1 each.
  • Spending cap. You may set a monthly spending cap. Calls that would exceed it are refused.
  • Expiry. Credits expire 12 months after your most recent purchase of credits. Any new purchase extends the whole balance. The developer portal shows when your current balance expires.
  • Nature of credits. Credits are a prepayment for API calls. They are not money, carry no interest, cannot be transferred to another account and cannot be exchanged for cash except as described in these API Terms or required by law.
  • Refunds. Unused credits are not refunded, except under Section 7, where we end the API Terms or stop the paid API without you being in breach (Section 13), or where the law requires a refund.
  • Chargebacks and negative balance. If a payment is refunded or disputed, the matching credits are withdrawn and returned if the dispute is resolved in our favour. A short delay in recording usage can take your balance slightly below zero; the next purchase covers the difference.

7. Right of Withdrawal for Consumers

If you are a Consumer in the European Union, you may withdraw from a purchase of credits within 14 days of the purchase without giving a reason, by writing to developers@caliplaces.com.

Credits are available to use as soon as the payment is confirmed. When you buy credits, you expressly ask us to start providing the service within the withdrawal period and acknowledge that you lose the right of withdrawal for the part of the service already provided. If you withdraw, we refund the credits from that purchase that you have not used, within 14 days and using the same payment method. Credits already used are not refunded.

8. Caliplaces Data, Attribution and Freshness

  • Attribution. Wherever you display Caliplaces Data, show "Data by Caliplaces" close to it and link it to the url of the item returned by the API.
  • Photos. Photos are provided with a Caliplaces watermark. Do not remove, crop out, cover or alter the watermark, and do not modify photos beyond resizing.
  • Accuracy. Do not alter Caliplaces Data in a way that changes its meaning, and do not present it as your own or imply that Caliplaces endorses your Application.
  • Freshness. You may cache Caliplaces Data for up to 30 days. After that, refresh it from the API or delete it. When an item is no longer returned by the API (for example because it was removed or is no longer public), stop displaying it within 30 days.

9. Third-Party Data Notices

Some Caliplaces Data comes from or is derived from third-party sources under their own licences. In particular, some place addresses are derived from OpenStreetMap data, © OpenStreetMap contributors, available under the Open Database License (ODbL). Where you display such addresses, include the attribution "© OpenStreetMap contributors" and comply with the ODbL. Any further notices are listed in the API documentation.

10. Restrictions

You may not:

  • Sell, license, redistribute or otherwise make Caliplaces Data available to third parties as data, including as a dataset, database, file export or API, or as part of a data product;
  • Use Caliplaces Data to build or substantially replicate a directory, map or database of calisthenics places, events or coaches that competes with Caliplaces;
  • Scrape, crawl or otherwise extract data from the Caliplaces website or apps instead of using the API;
  • Systematically download Caliplaces Data beyond what your Application needs to display, or try to rebuild the Caliplaces database;
  • Use Caliplaces Data to train machine-learning models that are offered to others or that reproduce the data;
  • Use coach or organiser information to send unsolicited marketing, to build profiles of individuals, or to combine it with other data to identify or track people;
  • Get around rate limits, quotas, spending caps or security measures, or interfere with the API;
  • Use the API for anything unlawful, deceptive or harmful, or in breach of the Acceptable Use Policy.

11. Personal Data

The API returns only public information. Some of it, such as a coach's name, photo, description and city, or an event organiser's name, is personal data. For your own processing of that data you are an independent controller under the GDPR and must:

  • Process it lawfully, only to show the related listings in your Application, and keep it secure;
  • Delete or refresh it as set out in Section 8, so that removed or corrected profiles disappear;
  • Handle requests from the people concerned that relate to your processing.

The API never returns private account data, contact details, bookings, messages or certification documents. How we process the personal data of developers is described in our Privacy Policy.

12. Availability, Changes and Versions

We aim to keep the API available and fast, but we do not guarantee uninterrupted availability and offer no service level agreement. We may add endpoints and fields at any time. Changes that break existing integrations are released under a new version (such as /open/v2), and we give at least 12 months' notice before retiring a version, unless a shorter period is required for security or legal reasons.

13. Suspension and Termination

You may stop using the API and delete your projects at any time. We may suspend or revoke your keys or projects, with notice where reasonably possible, if you breach the API Terms, if your use threatens the security or stability of the API, or if the law requires it.

We may end the API Terms or stop offering the API or the paid plan with at least 30 days' notice. If we do so without you being in breach, we refund your unused paid credits. When the API Terms end, stop using the API and delete cached Caliplaces Data within 30 days.

14. Intellectual Property

Caliplaces and its licensors keep all rights in the API, the Caliplaces Data and the Caliplaces name and logo. You may use the Caliplaces name only for the attribution required by Section 8. If you send us feedback about the API, we may use it without obligation to you.

15. Disclaimers

Caliplaces Data is largely contributed by our community and may be incomplete, out of date or inaccurate. It is provided "as is". It is not safety, medical or professional advice; tell your users to check conditions on site. To the extent permitted by law, we give no warranties about the API or the data, including of fitness for a particular purpose.

16. Limitation of Liability

To the extent permitted by law, our total liability arising from the API Terms is limited to the amount you paid us for credits in the 12 months before the event giving rise to the claim, or €100 if that is higher. We are not liable for indirect or consequential damage, lost profits or lost data.

These limits do not apply to damage caused intentionally or by gross negligence, to injury to life or health, or to any liability that cannot be limited by law, and they do not affect the mandatory rights of Consumers.

17. Indemnity

If you use the API in the course of a business, you will compensate Caliplaces for claims by third parties arising from your Application or from your breach of the API Terms, including reasonable legal costs. This section does not apply to Consumers.

18. Changes to These Terms

We may change the API Terms. We announce material changes by email to the address of your Caliplaces account at least 30 days before they take effect. If you do not agree, you may stop using the API before then, and we refund your unused paid credits on request. Continuing to use the API after the effective date means you accept the change.

19. Applicable Law and Jurisdiction

The API Terms are governed by the laws of the Czech Republic. The courts of Prague have jurisdiction over disputes with businesses. If you are a Consumer, you also keep the protection of the mandatory laws of your country of residence and may bring proceedings there.

Consumers may also turn to the Czech Trade Inspection Authority (Česká obchodní inspekce, www.coi.cz) for out-of-court resolution of consumer disputes.
